The Junta de Andalucía granted the Unified Environmental Authorisation on 15 December 2020. It sets environmental and operating conditions, but it does not replace the municipal permissions required from Mijas.
The authorisation required an in-situ sound report within three months of opening. Residents are asking whether it was submitted, requesting a copy and seeking a new assessment now that nearby homes are occupied.
The current Andalusian acoustic regulation sets activity-noise limits for predominantly residential areas at 55 dBA during the day, 55 dBA in the evening and 45 dBA at night. These limits must be assessed using the official methodology, not a phone reading alone.
Resident videos and consumer readings showing maxima above 70 dB do not prove a legal breach, but they provide a strong basis for an urgent official inspection and measurements at the affected flats.

The Andalusian Environmental Management Law was published on 20 March 2026 and came into force on 20 June 2026. It expressly covers noise and artificial light. Article 123 includes reducing light intrusion into homes among its objectives.
Articles 124 and 130 place inspection, control and enforcement of noise and exterior lighting from AAU activities with the Junta. Article 73 also allows an AAU to be reviewed when circumstances have changed or pollution makes revised conditions appropriate.
